Acceptable Use Policy

This Acceptable Use Policy ("AUP") is an integral part of our Terms of Service and governs your use of the TAG-d. platform and all associated services (the "Services"). Our goal is to foster a creative, safe, and positive environment for all users. By using our Services, you agree to abide by this AUP.
Capitalized terms used but not defined in this AUP have the meaning given to them in our Terms of Service.

Our Guiding Principle: Creativity with Responsibility
We provide powerful tools to help you create stunning sports graphics and digital posters. We trust you to use these tools responsibly and ethically. This policy outlines the boundaries of acceptable use to protect our community, our platform, and to comply with legal and ethical standards.

Prohibited Content: What Not to Create
You may not use our Services to create, upload, generate, or share any Inputs or Outputs that fall into the following categories.
2.1. Illegal and Extremely Harmful Content

Child Sexual Abuse Material (CSAM): Zero tolerance. We will immediately terminate your account and report any content depicting or suggesting the sexual exploitation or abuse of minors to the appropriate authorities, such as the National Center for Missing & Exploited Children (NCMEC).

Content Depicting Minors: You are strictly prohibited from uploading images of, or creating AI-generated content depicting, any individual you know or have reason to believe is under the age of 18.

Promotion of Violence, Terrorism, or Self-Harm: Content that incites, glorifies, or promotes violence against individuals or groups, supports terrorist organizations, or encourages or provides instructions for self-harm or suicide.

Extreme Gore and Graphic Violence: Depictions of gratuitous, sadistic, or extreme violence, including mutilation, torture, or severe physical harm to humans or animals.

2.2. Hateful, Harassing, and Abusive Content

Hate Speech: Content that attacks, demeans, promotes discrimination against, or disparages an individual or group based on race, ethnic origin, nationality, religion, sexual orientation, sex, gender, gender identity, age, disability, medical condition, or any other protected characteristic.

Harassment and Bullying: Content that targets individuals with abuse, threats, unwanted sexualization, or intimidation. This includes sharing private information about someone without their consent (doxing).
2.3. Infringement on Intellectual Property and Privacy Rights

Copyright Infringement: Using Inputs that you do not have the right to use.

Trademark Infringement: Creating Outputs that use third-party logos or brand names in a way that is likely to cause confusion.

Violation of Publicity Rights & Lack of Consent: Creating images or AI models of real people (including public figures) without their explicit consent. You must have obtained explicit, verifiable consent (such as in writing) from any individual whose likeness you use to create an AI model or generate images of them.
2.4. Deceptive, Fraudulent, and Misleading Content

Deceptive Synthetic Media (Deepfakes): Creating or sharing media of a real person that has been altered or generated to be misleading, deceptive, or to portray them in a false light, especially with the intent to defraud, defame, or harass. This includes both explicit and non-explicit deceptive content.

Electoral or Civic Misinformation: Generating or disseminating verifiably false information related to political campaigns, elections, or civic processes with the purpose of misleading the public or suppressing voter turnout.

Impersonation: Creating content designed to impersonate another person, brand, or entity in a deceptive manner to mislead others.

Creation of False or Misleading Documents: Using the Services to create fake identification, forged documents, or any other form of false photography or documentation intended to deceive or cause harm.

Spam and Scams: Creating content for the purpose of spamming, phishing, or promoting fraudulent schemes.
2.5. Adult and Sexually Explicit Content
Our Services are not a platform for creating pornography or sexually explicit material. Content that is sexually explicit, pornographic, or depicts nudity in a graphic or obscene manner is prohibited.

Prohibited Actions: How Not to Use the Services
Beyond the content you create, you must not use the Services to engage in the following activities:

System Disruption and Security Violations: Do not attempt to reverse engineer, decompile, hack, disable, or interfere with the proper working of the Services. This includes uploading viruses or malicious code, or launching denial-of-service attacks.

Data Scraping and Unauthorized Automation: Do not use any automated means (bots, scrapers, spiders) to access the Services, collect data, or generate Outputs in a way that is not an intended use of the platform, or that places an unreasonable load on our infrastructure.

Circumventing Safety Measures: Do not attempt to "jailbreak" or otherwise trick our AI models into violating this AUP or generating prohibited content. Deliberately crafting prompts to bypass our safety filters is a violation of these terms.

Account Misuse: Do not sell, trade, or transfer your account to another person. Do not create multiple accounts to evade suspension or other enforcement actions.

Violation of Law: Do not use the Services for any purpose that is illegal in your jurisdiction or in the jurisdictions where we operate.

Enforcement
We enforce this AUP through a combination of automated systems and human review. If you violate this AUP, we reserve the right to take action, in our sole discretion. Such actions may include:

Removing the offending content.

Issuing a warning.

Temporarily suspending your account or limiting its features.

Permanently terminating your account and access to the Services.
For users in jurisdictions like the European Union, in accordance with regulations such as the Digital Services Act (DSA), we will provide a statement of reasons for any such restrictive action and offer a pathway to appeal the decision through our internal complaint-handling system.

Reporting Violations
If you encounter content or behavior that you believe violates this AUP, please report it to us immediately through the reporting tools within the app or by contacting us at info@tag-d.com. Your reports help us keep the TAG-d. community safe.

Changes to This Policy
We may revise this AUP from time to time to reflect changes in our Services, the law, or community standards. We will notify you of significant changes, and your continued use of the Services after such changes constitutes your acceptance of the new AUP.
